Deposit: |
a. A deposit in the amount of $400 shall be forwarded to the captain along
with a signed copy of this agreement. This agreement shall have no force and effect
until such time as a deposit has been received. |

The balance shall be due and payable at the time of sailing. |
| 2. |
SAILING
TIME: |
The party is expected to be at the dock 15 minutes
before assigned sailing time. The captain will wait until one hour after the assigned
sailing time for the trip to commence and if the party fails to show by that time,
the captain reserves the right to cancel the charter and retain any deposit received
as liquidated damages. |
| 3. |
DURATION
OF CHARTER: |
Trip: The full day trip shall consist of 9 hours
to 11 hours.
The 1/2 day trip is 5 hours. |
| 4. |
NUMBER
OF PASSENGERS: |
6 people MAX |
| 5. |
TERMINATION
OF TRIP: |
a. It is understood that the captain shall be in
charge of this vessel at all times; and conduct on the part of the party which,
in the captain's discretion, may jeopardize the safety of the vessel or of others
on board shall be cause for the captain to terminate the charter and return to
the dock. In the event the charter is terminated in this manner, the full charter
price shall nevertheless be due. |

b.
In the event the captain, in his discretion, cancels a trip due to inclement weather,
then in that event, the captain will attempt to reschedule an alternate day or
return any deposit paid. In the event the trip is canceled because of weather
after the same shall have started, any refund will be prorated based on the hours
of the trip actually completed. |

c.
The captain reserves the right to cancel any trip in the event of mechanical failure
or illness of the crew. Provided, however, in the event of such cancellations,
the captain shall return all deposits paid hereunder. |

d.
Trips will be run to the best of our ability with due regard to current weather
conditions. Trips may be "downgraded" to the next appropriate category
when inclement weather persists. |
| 6. |
CANCELLATION: |
The
party shall have the right to cancel any scheduled trip by written notice received
by the captain not less than two (2) weeks prior to the scheduled date. After
such time, in the event of a cancellation, or failure to show, any deposit shall
be retained by the captain as liquidated damages. |
| 7. |
TACKLE: |
All
tackle for the trip will be provided by the captain. However, in the event tackle
is destroyed or lost through misuse by a member of the party, the captain will
expect reimbursement. |
| 8. |
FISH: |
All
fish caught on rod and reel are the property of the party with the exception of
giant bluefin tuna, medium bluefin, or bigeye tuna. The policy on tuna is that
1/3 of the tuna goes to the party, 1/3 to the boat and 1/3 to the captain and
crew. |
| 9. |
DRUGS: |
There
is a new U. S. Coast Guard policy on drugs found aboard charter fishing vessels.
We have to inform you that zero drugs are allowed on our boat. |
| 10. |
GRATUITY: |
We
anticipate you will plan on a gratuity for the mate's services which also include
all fish cleaning, filleting and packaging. The average gratuity is 15 - 20% of the cost of the charter. |
